Exempt Status – California

In recent months, several new firm exempt organization clients received tax notices from the State of California requesting  the filing of a 2009 tax return. 

These clients had gross receipts under $25,000 and therefore were not subject to filing a California return.  After further research we discovered that these clients have not received exempt status from the State of California.  Therefore, the State of California is requesting them to file a corporate tax return.

In order to avoid filing a corporate tax return, these entities need to file California Form 3500A to receive exempt status from the State of California.  This is a one page form and requires the exempt organization to attach a copy of the determination letter from the IRS.
